I should have also stated that your constitutional state rights are also measured against yours, and others constitutional federal rights. So the federal courts are going to be used to temper state rights for the protection of migratory fish.

The california constitution section 25, article 1 still gives the power to the state to set the conditions under which the different spiecies of fish may be taken. A closure of an area for the protection of spiecies is likely to survive any challenge under constitutional right, unless……the state gives a privilege to classes of fisherman, IE private companies that it doesn’t extend to individuals. So if it allowed certain companies to fish under some paid licensing or permit, but denied the public, that would be an infringement on your rights

In full disclosure I do need to say that I am a completely addicted sportfisherman. That being said ARE THEY NUTS?? We outsourced cust service to India, outsourced factories to China and now we are going to outsource the great outdoors to mexico?
